Man indicted on felonious assault charges

YOUNGSTOWN — Kenneth F. Spivey, 41, of Everett Avenue, was indicted Thursday on charges of felonious assault and misdemeanor assault for a Feb. 21 incident at the Town & Country Motel on Market Street in Boardman in which the owners were assaulted by a man staying at the motel.

Spivey is set for arraignment in Mahoning County Common Pleas Court May 5.

Boardman officers were called to the motel at 8:14 p.m. Feb. 21 and a witness reported seeing a man physically attacking the owners. The officer spoke with one of the owners, who had a bruised wrist and bloody mouth, elbow and knee, and a bump on the head, a police report states.

The owners said a woman rented the room about 7:24 p.m. that evening and had a man with her. They rented the room for two people. But later two other people arrived and went into the room.

The owners then went to the room and said the two additional people needed to leave. They walked away from the room. But a “taller, skinny” man approached one of the owners and confronted him, yelling, then struck the owner in the face, knocking him into a wall.

The suspect hit the owner again, causing him to fall fall unconscious with his head hitting the concrete. The suspect walked back to the room, but threw off his red shirt into the road. He went back to the room, then walked out again and threw a beer can into the parking lot. He got into an older dark-colored Chevy Trailblazer, which left the area.

The next day, Boardman police learned the owner got five stitches inside his mouth. Officers reviewed surveillance video and preserved images of the Trailblazer and the suspect, the report states.

At 10:26 p.m. Feb. 22, a Boardman officer spotted a blue Trailblazer on Southern Boulevard that was speeding, A traffic stop was made, and officers spoke with the driver, a woman and a man in the car.

Later that night, Boardman police learned more about what happened at the motel and learned about a male named “Kenny.” Officers arrested Spivey Feb. 28 after Youngstown police took Spivey into custody on warrants following a traffic stop. The warrants were for felonious assault and misdemeanor assault by Boardman police. The warrants were filed in Mahoning County Boardman area court Feb. 24.
