Brendan Daviduk could get plea in arson death of 16-year-old Warren girl
WARREN — A Youngstown man facing capital murder charges in the January 2023 arson that killed a 16-year-old girl appeared in court Wednesday, where his lawyers and the prosecution said a plea offer is in the works.
Brendan Daviduk, 30, is scheduled for a May 14 trial in the courtroom of Trumbull County Common Pleas Judge Sean O’Brien.
Appearing in O’Brien’s courtroom Wednesday, Trumbull County Assistant Prosecutor Michael Burnett, along with Daviduk’s attorneys, Rhys Brendan Cartwright-Jones and Louis M. Defabio, had a pretrial hearing where O’Brien stated that a plea deal in the case is expected soon.
Daviduk faces two counts of aggravated murder with death penalty specifications, two counts of attempted aggravated murder, first-degree aggravated arson, second-degree aggravated arson, aggravated burglary and tampering with evidence.
The aggravated murder specifications state that a felony was committed in the act of the murder.
Daviduk and co-defendant Patricia Zarlingo were arrested Feb. 1, 2023, at their home on the West Side of Youngstown, where police noticed a U-Haul van in the driveway.
Daviduk is one of three accused of starting the house fire that killed Chassidy Broadstone and hospitalized her two sisters.
U.S. Marshals arrested a third suspect, Zackary Gurd, on Feb. 3, 2023, in Chester, Va. Authorities believed he was fleeing to Florida after he found out he was wanted for questioning.
In December, Gurd accepted a plea agreement that helps him avoid the death penalty but still leaves him facing 40 years to life in prison. Gurd is set to be sentenced in the courtroom of Judge Cynthia Rice following the resolution of the cases against Daviduk and Zarlingo.
