Penn duo working on deal in Capitol case

NEW CASTLE, Pa. — Two New Castle residents facing charges connected to the Jan. 6, 2021, breach of the U.S. Capitol are working with prosecutors on a possible plea deal to complete their case in U.S. District of Columbia court.

Philip Vogel and Debra Maimone each face five counts of federal charges in connection to the breach during the counting of the electoral votes of the 2020 presidential election.

In a case status report submitted to the court on Friday, both sides reported no disputes of evidence, which included an FBI file and defense counsel access to a tour of the crime scene directed by U.S. Capitol police. The report also stated the government will make a formal plea offer shortly to the defense.

Defense counsel, federal public defenders A.J. Kramer and Elizabeth Mullin, plus Vogel’s attorney, Allen H. Orenberg, stated they need time to review an offer and to propose any counteroffer. If an offer is accepted, the parties will need additional time to work out more details prior to sentencing, they said.

U.S. Judge Randolph D. Moss granted that speedy trial time be waived and ordered another status report be filed by Sept. 20.

Vogel and Maimone run a McKees Rock, Pa., contracting and cleaning services business.

The two, who were arrested March 19, 2021, have been free on personal bonds. They are charged with theft, two counts of knowingly entering or remaining in any restricted building or grounds without lawful authority, and two counts violent entry and disorderly conduct on Capitol grounds.

The FBI identified the two through a video posted to social media showing them inside the Capitol on Jan 6.

Vogel was identified as the one taking the video, which showed the interior of the Capitol building. At one point, Maimone is seen pulling down her American Flag mask, according to documents and Vogel told her “put your mask on. I don’t want them to see you.”

The FBI’s investigation included matching Vogel’s voice from the video to a Pittsburgh television interview he gave in October 2020 during a fishing boat mishap in the Ohio River.

Capitol video also showed the two taking silver packages from a police bag. These packages contained personal protective equipment, court documents state.
