Sellers murder trial about to begin again in Mahoning courtroom

Staff photo / Ed Runyan Danyo Sellers, 19, was brought into the courtroom again this morning to be tried on murder and other charges in the April 15, 2023, shooting death of Amya Monserrat, 15, outside Martha’s Boulevard Tavern on Southern Boulevard in Youngstown.

YOUNGSTOWN — Danyo Sellers, 19, and dozens of potential jurors are in. the courtroom of Judge Anthony D’Apolito of Mahoning County Common Pleas Court this morning in preparation for Sellers to go on trial again this week in the April 15, 2023, shooting death of Amya Monserrat, 15, outside Martha’s Boulevard Tavern on Southern Boulevard in Youngstown.

Sellers went on trial last week in the same case, but a mistrial was declared, apparently because of a key witness refusing to testify, invoking his Fifth Amendment rights against self-incrimination. It is not clear whether prosecutors have another way to bring that witness’s testimony into the trial.

According to the Brittanica.com web site, a mistrial is a trial that has been terminated and declared void before the tribunal can hand down a decision or render a verdict. The termination of a trial prematurely nullifies the preceding proceedings as if they had not taken place. Therefore, should another trial on the same charges, with the same defendants, be ordered, that trial would start from the beginning, with the previous testimony or other findings not necessarily relevant in the new court proceedings.

Starting at $3.23/week.
