Warren man sentenced to 10 to 15 years for rape of juvenile

YOUNGSTOWN — Daniel Ortiz-Torres, 50, of Homewood Avenue SE in Warren, was sentenced to 10 to 15 years in prison Thursday after pleading guilty in September to one count of rape and one count of gross sexual imposition.

Ortiz-Torres got the sentence jointly recommended by the prosecution and defense. He got credit for 452 days spent in the Mahoning County jail awaiting trial.

According to his indictment, Ortiz-Torres engaged in sexual conduct with a juvenile between Jan. 31, 2018, and July 26, 2022, by compelling the victim by force or threat of force and also had sexual contact with the same juvenile between Jan 31, 2015, and Jan. 31, 2018, when the juvenile was younger than 13. The offenses occurred in Mahoning County, according to the indictments.

In exchange for his guilty pleas, prosecutors dismissed 19 other charges in Ortiz-Torres’s indictments. Among those were three counts of rape that could have resulted in Ortiz-Torres getting a life prison sentence if convicted and four other rape charges. Ortiz-Torres is now a tier 3 sex offender, required to register his address every 90 days for the rest of his life with the sheriff’s office where he lives when he leaves prison.

Mahoning County Common Pleas Court Judge Anthony Donofrio presided over the case, including a suppression hearing in May to determine whether remarks Ortiz-Torres made to a Warren detective should be suppressed from evidence.

Ortiz-Torres’ attorney, Mark Lavelle, argued in a suppression filing that the comments should be suppressed because Ortiz-Torres “is from Puerto Rico and struggles with the English language.” But Donofrio denied the motion.
