Three plead not guilty to assault at Walmart

LIBERTY — Three Youngstown individuals accused of assaulting a man in the parking lot of Walmart pleaded not guilty in Girard Municipal Court on Thursday.

Joseph Boylen, 23, and Scott Maxwell, 44, each pleaded not guilty to their respective charges of misdemeanor assault. Alexis Boylen, 25, pleaded not guilty to her charges of assault and criminal damaging.

According to a police report, officers were dispatched to Walmart because of a physical altercation that stemmed from a crash that occurred in Youngstown. Upon arrival, officers found multiple people yelling at one another, resulting in them being separated.

The individuals, who were identified as Alexis, Joseph and Maxwell, told officers hey followed a man into the parking lot because they recognized his vehicle from a hit-and-run crash nearly a month ago — confirming that a report was already filed.

The report states they said they never assaulted the man and followed him only so they could take pictures of his vehicle’s damage and give it to the Youngstown Police Department.

However, the report states the man said the trio followed him to Walmart and approached his vehicle, and when he got out of it, he was assaulted by the Boylens and Maxwell. He told the officers he was thrown on the ground at one point, and they observed a scrape on his hand that appeared to be fresh.

The man said the trio also broke out the rear window of his vehicle, and he wished to pursue charges against them.

The report states officers reviewed Walmart’s security footage, which revealed the man exiting his vehicle and being immediately confronted by Joseph, Alexis and Maxwell. The report states the footage showed all three appeared to be yelling at him.

At one point, the footage shows Alexis appearing to smack the man in the face before he was seen running west through the parking lot. The report states that the three chased him, and Joseph and Maxwell were observed in the footage squaring up with the man and physically assaulting him before he was seen falling to the ground.

The footage shows Alexis walking away, grabbing an item from a vehicle, and starting to smash out the back window of the man’s vehicle.

The report states the trio was to be arrested for assault, with Alexis receiving a criminal damaging charge.

All three individuals posted bond as of Thursday and are set to appear back in court Oct. 9, according to court records.
