Chief deputy clerk of courts files suit over 2023 incident at her home

YOUNGSTOWN — Mahoning County Chief Deputy Clerk of Courts Jennifer Ciccone has sued Timothy G. Lucas of East Liverpool, Giant Eagle Supermarkets and others for a July 23, 2023, incident at her home in Poland Township in which she alleges Lucas struck her with his car as part of a dispute.

The Vindicator reported on the incident a couple days after it happened and shortly after Lucas appeared in Struthers Municipal Court on a felonious assault charge filed against him by the Poland Township Police Department over the incident.

The Poland Township police report stated that Ciccone told police she had groceries delivered to her home from the Poland Giant Eagle store and that Lucas, 52, was the driver for the delivery. She and Lucas got into an argument after Lucas asked for her ID because the order included alcohol, the report stated.

Ciccone said she had misplaced her driver’s license but attempted to show Lucas a valid passport. She said he became angered when she asked him what company he worked for, and Lucas said he was canceling her order and putting her on a “do not deliver” list, according to the report.

Ciccone and other witnesses told police that when Ciccone stood behind Lucas’ vehicle to write down his license plate number, he put the car in reverse, backed up and struck her. Then he pulled forward, reversed and struck her again, causing arm and leg injuries, according to the report.

While police were at Ciccone’s house, they put out an all-points bulletin on Lucas’ vehicle. Other officers on duty spotted the car on McKinley Way in Poland Village and pulled over Lucas. The report states that Lucas admitted to hitting Ciccone, but he said it was her fault. He was arrested and booked into the Mahoning County jail.

However, court records related to the incident are no longer on file in Struthers Municipal Court online records, and there is no indication that the case was bound over to common pleas court.

The lawsuit, filed pro se by Ciccone, a lawyer, and her husband, Daniel Superak, states that Lucas was believed to have been an “employee contractor as a delivery driver by or on behalf of Giant Eagle Inc.”

The suit states that when Lucas requested photo identification for the alcohol, she explained that she had misplaced her driver’s license but had a valid U.S. passport and stepped away to get it.

But Lucas “became enraged at this point and demanded a driver’s license but would not accept (Superak’s) license,” the suit states. While Ciccone was retrieving her photo ID, Lucas “decided to unilaterally terminate the delivery without just cause or reason,” the suit states.

Lucas headed to his vehicle, which was parked in the driveway, while Superak called 911 from his cellphone, the suit states. Lucas put his car in reverse while Ciccone was standing behind the vehicle obtaining his license plate number, the suit states.

Lucas knew that Ciccone “was behind his vehicle but still put the vehicle in reverse and proceeded to intentionally strike” Ciccone, “causing injury to her arm, leg and trauma to her head,” the suit states. Lucas then fled, “causing additional trauma and distress,” the suit states. Neighbors saw the incident, it adds.

As a result of the incident, Ciccone “sustained physical injuries, pain, emotional distress, mental anguish, incurred medical expenses, trauma, embarrassment and lost wages from missing an extended amount of work due to being diagnosed with a traumatic brain injury,” the suit states.

The suit states that Giant Eagle Inc. and / or Giant Eagle Supermarket and others “breached duties to the public,” by “negligently hiring, training, contracting with or supervising defendant, Timothy Lucas.”

The suit alleges that Lucas pleaded guilty to a charge in the incident.

The suit seeks compensatory damages of $75,000, unspecified punitive damages and unspecified damages of consortium on behalf of Superak.

Joe Mosbrook, spokesman for Giant Eagle, said he cannot comment on pending litigation. An attempt to locate a phone number or other way to contact Lucas to seek comment was unsuccessful.
