YOUNGSTOWN — The retrial of Dustin Ruiter, 50, of Warren and Youngstown, began Monday with jury selection in Mahoning County Common Pleas Court.

Opening statements in the trial and first witnesses will begin today.

Ruiter went on trial in 2021 on the same charges of rape, attempted rape, sexual battery and gross sexual imposition, and a jury found him guilty.

But the 7th District Court of Appeals overturned all but two of Ruiter’s convictions and ordered a new trial, disagreeing with Judge Anthony D’Apolito’s decision to deny Ruiter the assistance of a DNA expert at his trial.

The majority’s ruling from the 7th District Court of Appeals stated that the ruling was not an opinion on the evidence or guilt or innocence of Ruiter, only on the “adequacy of the process leading up to a decision.”

One of the alleged victims reported her allegations against Ruiter in June of 2019. Ruiter’s last known address was on South Lakeview Avenue on Youngstown’s West Side. Ruiter’s Warren address was on Candace Street Southeast.

He has been in the Mahoning County jail since Oct. 3, 2023, according to jail records.
