LIBERTY -- A Sharon man faces charges after Liberty police said they observed him committing multiple traffic violations and striking a divider Saturday.
David Gammon, 44, pleaded not guilty to two charges of operating a vehicle while impaired and a charge of open container in front of Girard Municipal Court Judge Jeffery Adler on Tuesday morning.
According to a police report, an officer traveling southbound on Belmont Avenue near Interstate 80 noticed a white Kia Soul leaving the highway onto Belmont, heading northbound.
The vehicle crossed both lanes and struck the center curb divider while turning onto Belmont, prompting the officer to turn around and conduct a traffic stop; the report also notes that the vehicle changed lanes without using a turn signal.
The officer spoke with Gammon, the driver, and smelled an odor of an alcoholic beverage and noticed a tall can of beer on the vehicle's passenger floor, adding that Gammon's eyes were bloodshot and watery and his speech was slurred.
The report states Gammon said he had nothing to drink, and the officer asked Gammon to step out of his vehicle for a field sobriety test.
The report states Gammon showed seven of eight clues of impairment during the walk and turn portion of the test and three of four clues during the one-leg stand portion, with officers noting he struggled to balance himself.
Gammon agreed to a preliminary breath test, showing a blood/alcohol concentration of 0.92 -- resulting in him being placed under arrest for operating a vehicle while impaired.
He took another breath sample at the Liberty Police Department, which showed a final result of 0.275, which is nearly four times the 0.08 legal limit, the report states.
Gammon was released to a sober and responsible party after the officer provided him with the proper paperwork and citations.
Gammon is set to return to court Oct. 7, court records show.
