Man faces OVI, child endangerment charges
LIBERTY — A Youngstown man who blew nearly three times over the legal limit with two children in the car over the weekend made an appearance in court.
Billy Hendrix, 45, pleaded not guilty to two charges of DUI, child endangerment and a misdemeanor charge in front of Girard Municipal Court Judge Jeffery Adler Monday morning.
According to a police report, officers were called to Trumbull Avenue for a crash with possible injuries after dispatchers said they received a call from OnStar, a subscription-based vehicle safety service, reporting that a black Cadillac XT5 had crashed with airbag deployment.
The report states officers arrived on scene and found the vehicle in a ditch with its four-way flashers on, and all side airbags were deployed.
An officer spoke with Hendrix, the vehicle’s driver, who said he wasn’t injured but couldn’t get out of the car, so officers assisted him.
The report states that before they could ask if anyone else was in the vehicle, two young juveniles, a 3-year-old and a 10-year-old, got out of the vehicle too, and they were observed to have no injuries and escorted to a police vehicle until paramedics arrived.
Upon being asked what happened, Hendrix said another vehicle drove him off the road, adding that he didn’t really remember what happened and that he typically drives between 10 to 15 mph, according to the report.
Officers noted an alcoholic beverage scent from Hendrix’s breath, slurred speech, and an inability to keep his balance as they spoke with him. Hendrix admitted to the officer that he had three shots over the course of three hours, the report states.
The report states Hendrix agreed to a field sobriety test, but concluded it after he fell to the ground and struggled to get up while putting his shoes back on.
The vehicle was towed out of the ditch, and officers searched it, finding an open 1.5 oz bottle of Crown Royale and a mason jar with a green leafy substance in it.
Hendrix agreed to give officers a breath sample, showing a blood alcohol concentration of 0.217 — two and a half times the state’s 0.08 legal limit, the report states.
Officers were able to acquire a phone number for the children’s grandmother, who was willing to take custody of them.
Court records show Hendrix is set to appear back in court July 22, and he was released on bail Monday.
