Resolution reached in Ursuline hazing suit

YOUNGSTOWN — With the dismissal of an Ursuline High School student/football player and his mother April 28, all of the students and most of the parents in a hazing lawsuit reached a settlement in the case.

An April 28 entry states that “pending probate court proceedings,” the lawyers for the victim of the hazing reached a settlement with the Ursuline student defendants and their families.

Not yet dismissed from the suit are Ursuline High School; its former head football coach, Dan Reardon; its principal, Matthew Sammartino; its assistant principal, Margaret Damore; assistant football coaches Timothy McGlynn and Christian Syrianoudis; Athletic Director and Assistant Football Coach John DeSantis; and the Catholic Diocese of Youngstown.

The 10 other students resolved their part of the lawsuit March 18 in a similar way as the dismissal of the student and parent April 28. Those defendants’ part in the lawsuit is also dismissed pending probate court proceedings, according to court documents.

The terms of the settlements with the students are not known. But when the terms are finalized in probate court, they are likely to spell out the amount of money that will go to the plaintiffs and the amount that will be paid to their attorneys.

The lawsuit was filed in September in U.S. District Court in Youngstown by a mother and her son, alleging sexual abuse committed against her son while he participated in an Ursuline High School football team trip last summer.

The suit later also alleged a four-year pattern of hazing, sexual abuse and coverups within the football program and a second victim who suffered abuse on a similar trip one year earlier.

SECOND LAWSUIT

A second lawsuit filed one week later, also by the Chandra Law Firm of Cleveland, alleged sexual harassment of a female Ursuline student by an Ursuline football player in June of 2023. That lawsuit also alleged that the school district failed to protect students, including allegations that school officials were aware of the allegations.

The Chandra Law Firm notified the court April 29 that, pending probate court proceedings, that lawsuit also had been resolved through a settlement with the Catholic Diocese of Youngstown, Ursuline High School, Damore and DeSantis, according to court documents.

That suit was dismissed as to the claims against an Ursuline player and three people listed as his parents, court documents state.

THIRD LAWSUIT

A third federal lawsuit alleged misconduct by football players against an openly gay Ursuline student in ways that violated federal and state law and the United States Constitution. That suit also alleged school officials were aware of the allegations and did not stop the harassment, despite persistent efforts by the boy’s guardian.

The docket in that lawsuit also states that on April 29, the Chandra Law firm notified the court that, pending probate court proceedings, that case also had been resolved through a settlement with the Diocese of Youngstown, Ursuline High School and Damore. The docket does not list any individual football players as defendants.

FOURTH LAWSUIT

A fourth lawsuit was filed Nov. 25 in Mahoning County Common Pleas Court alleging that school officials did not protect an Ursuline High school girl from threats that resulted in an alleged physical attack by another girl.

The docket in that case, which is before Judge Anthony Donofrio, had a mediation on Friday, but no resolution was reached, according to court documents. The defendants named in that lawsuit are Ursuline High School, Damore and the Catholic Diocese of Youngstown.
