Liberty man set for trial on two felonious assault charges
WARREN — A trial date of April 9 is set for Michael R. Derr, 33, of Mansell Drive in Liberty, on two counts of felonious assault, one count of being a felon in possession of a firearm and two counts of domestic violence in a Nov. 10 incident involving him and a woman in the parking lot of the Liberty Plaza on Belmont Avenue.
He and prosecutors did not reach a resolution to his case during a pretrial hearing Tuesday before Trumbull County Common Pleas Court Judge Ronald Rice, so he is now set for trial. Another pretrial is scheduled April 9 so Derr has another chance at taking a plea before his trial begins.
Liberty officers were sent to the Walmart parking lot at 4:46 p.m. Nov. 10 for a reported disturbance involving a woman and Derr, her boyfriend, who she said had rammed her car with his car.
Police located the woman and her vehicle, which had heavy damage to the rear, including the bumper being off. She said her 6-month-old child was not responsive, but officers checked on the child, and he was breathing and apparently uninjured. Liberty Fire Department personnel responded and transported both the woman and her baby to the hospital for evaluation.
The woman provided information on Derr and his vehicle, and after searching the area, officers found Derr’s car at his home on nearby Mansell Drive. Officers surrounded Derr’s home and called out to Derr over a public address system asking him to surrender, which he did, according to prosecutors.
When officers spoke to Derr, he said his girlfriend kept “brake checking” him in the parking lot. Derr’s speech was slurred and officers detected a strong odor of alcoholic beverage on him. Derr admitted to striking his girlfriend’s car, but said he did not mean to, a police report from the incident states.
When Derr was asked if he knew his son was in the woman’s car, he said he did. He said he and the woman had lived together for several months and had been together several years.
Officers saw damage on Derr’s vehicle, which they towed for investigative purposes.
While taking the vehicle’s inventory, police found a handgun under the front passenger seat and ammunition in a bag in the back seat. They were taken into evidence. Derr denied knowing the items were in the car. He was taken to jail on several charges.
The woman told police that Derr lost his job that day and was angry. She said she was planning to drive to a relative’s house because of the way Derr was acting, but Derr followed her at high speed to catch up to her.
She said she pulled over in the store parking lot out of fear for her child’s safety. Derr pulled up next to her and they argued. She said she tried to drive away and get to an area where there were more people around, and Derr rammed her car.
She drove to an area close to a store, and Derr drove away.
If Derr is convicted of the two felonious assaults, he could get about 16 years in prison.
