Jury convicts man on 67 sex charges

YOUNGSTOWN — A jury found Dustin L. Ruiter, 50, guilty Thursday on all 67 sex charges he faced in a trial in Mahoning County Common Pleas Court over four days. Jury deliberations took two hours.

Ruiter was convicted of 33 counts of rape — 21 of them involving the forcible rape of one girl and 12 of them for the forcible rape of a second girl.

Mahoning County prosecutors said Ruiter began to sexually abuse one girl in 2018 and then a second girl after that. They both disclosed the assaults to a trusted adult in June 2019. Ruiter also was convicted of one count of attempted rape and 33 counts of sexual battery involving the same two girls.

Ruiter also went on trial in 2021 in Mahoning County on similar charges, and a jury found him guilty of 73 sex offenses, including 33 counts of rape.

But the 7th District Court of Appeals overturned all but two of those convictions and ordered a new trial, disagreeing with Judge Anthony D’Apolito’s decision to deny Ruiter the assistance of a DNA expert at his first trial.

The majority’s ruling from the 7th District Court of Appeals stated that the ruling was not an opinion on the evidence or guilt or innocence of Ruiter, only on the “adequacy of the process leading up to a decision.”

Ruiter’s last known address was on South Lakeview Avenue on Youngstown’s West Side. But Ruiter also had an address on Candace Street Southeast in Warren in court documents. He has been in the Mahoning County jail since Oct. 3, 2023, according to jail records.

After the first trial, Judge Anthony D’Apolito sentenced Ruiter to 77 years in prison.

Assistant prosecutors Caitlyn Andrews and Kristie Weibling prosecuted the case. Ruiter’s attorney was James Wise. Ruiter will be resentenced later.
