YOUNGSTOWN — Xiaoyan Tu, 35, of Flushing, New York, who was sentenced to one year of probation in Mahoning County Common Pleas Court after pleading guilty to felony promoting prostitution and misdemeanor soliciting Oct. 15, has been deported to China, according to court documents.
A Dec. 4 judgment entry in her case states that the one year of probation she was ordered to serve was terminated.
The reason was that Tu was “removed from the United States of America from Detroit, Michigan, and extradited to Shanghai, China, Nov. 23, per the Immigration Customs Enforcement agent,” according to the Dec. 4 judgment entry signed by Mahoning County Common Pleas Court Judge Anthony D’Apolito.
As a result of Tu’s extradition, Adult Probation officers recommended to D’Apolito that he terminate Tu’s probation, and he agreed.
Tu’s charges stemmed from her arrest March 14 during an investigation of the Sunshine Foot Spa, 445 W. Main St. in Canfield.
Tu pleaded guilty to a fourth-degree felony charge of promoting prostitution and a third-degree misdemeanor charge of soliciting prostitution and was sentenced to probation Oct.15 before D’Apolito, according to court documents. The one year of probation was an agreed-upon sentence by the prosecution and defense.
As part of her probation, Tu was ordered to submit to random drug and alcohol tests. The judgment entry approved the transfer of Tu’s probation to Flushing, when deemed appropriate by (the Adult Probation Authority).”
The order also approved the return of Tu’s passport to her.
