Youngstown man expected to get three years for drug possession
YOUNGSTOWN — Allister R. Smith Jr., 32, of West Florida Avenue in Youngstown, pleaded guilty Tuesday in Mahoning County Common Pleas Court to a first-degree felony cocaine possession charge for possessing the drug Sept.19, 2024.
Smith’s indictment states that Smith knowingly obtained, possessed or used the drug, and the amount was between .06 pounds and .22 pounds.
He also pleaded guilty to a specification attached to the charge stating that he forfeits the $450 in currency that was seized because it was “an instrumentality the offender used or intended to use to in the commission or facilitation of the offense.
The funds were “drug proceeds and / or used to purchase more drugs and or drug paraphernalia and / or used to facilitate the transfer and / or transportation of the drugs and / or or drug paraphernalia,” Smith’s indictment states.
Judge John Durkin will sentence Smith at 10:30 a.m. Dec. 11. Mahoning County prosecutors will recommend that Smith get 3 to 4 1/2 years in prison, said Mahoning County Assistant Prosecutor Anisa Modarelli.
The investigation was handled by the Mahoning County Law Enforcement Task Force, but Youngstown police made the arrest on Smith.
