Ciccone divorce proceedings dismissed at plaintiff’s request

YOUNGSTOWN — Visiting Judge Debra Boros dismissed the divorce case filed by Emily Ciccone against her husband, Mahoning County County Clerk of Courts Michael Ciccone, at Emily Ciccone’s request.

Boros, a retired former Lorain County Common Pleas Court judge who was appointed to the case in Mahoning County Domestic Court by the Ohio Supreme Court, dismissed the case Oct. 22.

Emily Ciccone’s pro-se (without an attorney) notice of voluntary dismissal, filed Oct. 21, stated that the request was “without prejudice” and “otherwise than on the merits,” meaning it could be filed again.

The Ciccones agreed Oct. 15 to shared parenting of their two children on an every-other-week basis. Michael Ciccone was going to have parenting time Sunday evening until Wednesday morning, starting Oct. 12. Emily Ciccone was going to have parenting time Wednesday morning until Sunday evening the first week. During the following week, the times and dates were reversed.

The couple also had a mutual restraining order against each other effective Oct. 7, according to another document in the case.

Emily Ciccone was arrested Sept. 25 on a domestic violence charge over an alleged incident involving her husband following an argument at their home in Austintown.

The misdemeanor charge was dismissed Oct. 14 when the prosecutor in the case cited a lack of evidence.

She was initially charged after her husband told police he was sitting on the toilet when his wife threw numerous objects at him, including a coffee mug and a Stanley drinking cup, and one of them struck him on the right leg, causing him to bleed, according to the police report. He was treated for injuries to his leg at St. Elizabeth Youngstown Hospital.

Ciccone told police he would need stitches for his injuries and that he wanted to press criminal charges against his wife.
