Candidate claims self-defense after Austintown arrest
AUSTINTOWN — There are new developments in the case of a county official and his politician wife after she was arrested on a charge of domestic violence last week.
Emily Ciccone, a candidate for Austintown Township trustee, was arrested Sept. 25 after allegedly attacking her husband, Mahoning County Clerk of Courts Michael Ciccone.
Emily pleaded not guilty to the first-degree misdemeanor Monday in Austintown Court, has paid a $3,500 bond and has been released from Mahoning County jail. She is ordered to have no contact with Michael or the children for the duration of the case.
Michael filed a civil protection order against Emily on Friday, for himself and the couple’s three children — two sons and a daughter, ages 2 to 4. The Austintown police report states at least two of the children were home Thursday night and saw a fight.
On Monday, Emily filed a motion in Mahoning County Austintown Court, declaring that she intends to claim self-defense in the case and alleging Michael hit her that night and has hit her on multiple occasions in the past.
Mahoning County Court records do not show any domestic violence or criminal charges of any kind filed against Michael Ciccone.
The filing does not cite any specific dates on which the alleged attacks occurred and does not provide any detail about when Michael may have hit her Thursday.
The document states Emily intends to call as supporting witnesses Chief Deputy Clerk of Courts Jennifer Ciccone (no relation), her husband, Poland Township police officer Daniel Superak and Poland Township beauty queen Elena Yemma.
The Austintown police report states on Thursday — after Emily allegedly threw a coffee mug at him that shattered and caused a significant cut to his leg — Michael called Jennifer to the house to deescalate the situation, and she called police after arriving and surveying the scene.
Jennifer told dispatchers Emily also threatened to kill Michael and the children, and Michael’s statement alleges that Emily also threatened to shoot Jennifer.
The protection order requires Emily to surrender her gun and temporarily invalidates her concealed carry permit.
Michael said he was sitting on the toilet when Emily began throwing things at him, including the cup that cut him. At some point she hit him with a vacuum cleaner.
When police responded to the South Edgehill Avenue home just before 10 p.m., Michael told police Emily became irate when she heard him calling Jennifer to pick him up to “alleviate the current argument.”
Michael told police Emily tried to help him by placing a towel on the leg wound and then she cleaned the blood from the floor while he sat in the bathtub.
Austintown police officer Connor Grenier reported he saw several red scratches on Michael Ciccone’s forehead and the right side of his neck, which the victim said were caused by his wife.
Grenier also noted that the home was in “deplorable condition…with numerous used dog diapers on the floor, old food items scattered…to the point where the counters were not visible. The kitchen sink was also overflowing with unclean dishes and old food items. The children’s rooms were also filthy with toys and numerous items covering the floor.”
Michael hired Jennifer as his chief deputy, raising her starting salary of $120,000 annually to $156,000 on April 20. After a failed bid to retain her appointed seat as Struthers Municipal Court judge in 2023, she also lost a 2024 election for county commissioner. She was disqualified earlier this year from being an attorney in county domestic relations court because of her position. She also failed to obtain certification as a Poland Township trustee candidate because she incorrectly identified Mahoning as her township on one of her positions.
Jennifer and Superak filed a $75,000 lawsuit against Timothy Lucas, a delivery driver for Giant Eagle, who Ciccone claims hit her with his car in her driveway in July 2023.
The driver has filed a countersuit for the same amount, claiming that Jennifer and Superak lied about what happened after Jennifer became irate because Lucas asked her to show ID for the alcohol in her order.
