Newton Falls man pleads not guilty to OVI charges
LIBERTY — A Newton Falls man whom Liberty police arrested in response to an early morning report of a crash made a court appearance Monday.
David Hunt, 26, pleaded not guilty to two charges of OVI, open container and operation without reasonable control in Girard Municipal Court.
According to a police report, officers were dispatched to Taylor Avenue after dispatchers informed officers that a caller heard a vehicle traveling northbound on the road at a “high rate of speed — crashing into the cul-de-sac’s woods. While en route, dispatchers reported that the driver was attempting to back out the vehicle.
The report states dispatchers told officers the man became argumentative with the caller and began running southbound on Taylor Avenue toward Churchill Road.
The reporting officer made contact with the man, later identified as Hunt, who was on his cell- phone, ordering him to the front of his cruiser to find out what happened.
The officer noted an alcoholic beverage odor on Hunt, as well as wobbly balance and mud on him, according to the report, adding that his speech was slow and slurred.
The report states Hunt told the officer that he had a couple of drinks and that his car was nearby, adding to him that “I don’t want to say too much to get myself in trouble” and “I want you to understand, I know that I am drunk.”
The report states that, upon being asked for his driver’s license and insurance, Hunt provided officers with his license, as well as an Ohio medical marijuana card and a Pokemon card, but was unable to find his insurance.
Hunt told Liberty Fire Department members he was not injured but wanted to know why his car was stuck.
The report states the officer asked Hunt if he wanted to perform a field sobriety test, but he declined. Hunt informed officers of his medical marijuana card and that he was on probation with Newton Falls.
The report states Hunt agreed to give a breath sample after being transported to the Girard Police Department, where results showed him with a blood-alcohol content of .243, which is three times the legal limit of 0.08.
The officer went back to the Taylor Avenue crash site and found Hunt’s vehicle, a dark blue Chevrolet Equinox, in the wooded area, and towed it from the scene. The officer performed an inventory search beforehand, where he found an open container of Tito’s vodka on the front passenger floorboard of the vehicle with a fourth of it left, according to the report.
Hunt was brought to the Liberty Police Department to complete paperwork, where he was issued two OVI citations, the second one being for individuals with a BAC concentration of .17 or higher.
At his court appearance, Girard Municipal Court Judge Jeffery Adler imposed a pretrial suspension and stay of administrative license suspension. Hunt was granted occupational driving privileges from 5:30 a.m. to 5 p.m. Monday, Tuesday, Wednesday, Thursday and Saturday.
Hunt is set to appear back in court Sept. 24, according to court records.
