Campbell woman indicted in Struthers assault case
YOUNGSTOWN — Hailey F. Levonyak, 18, Kendal Avenue, Campbell, was indicted on felonious assault last week for a June 13 incident in which she is accused of causing serious physical injuries to another person at a Struthers home on Poland Avenue.
According to a Struthers Municipal Court document, Struthers police were called to the home and spoke with Levonyak, who said, “Take me to jail. I low-key beat her (body part).”
Officers entered the home and found a person on the floor of the bathroom with “significant swelling to both eyes and falling in and out of consciousness,” the document states.
Officers notified the Struthers Fire Department and Lane Ambulance Service, which took the victim to St. Elizabeth Youngstown Hospital.
Struthers police took Levonyak to the Struthers Police Department, where she told officers that she “became upset after (the victim) scratched (Levonyak) and tore (Levonyak’s) shirt while (Levonyak) was attempting to help (the victim) up from the ground, so (Levonyak) struck (the victim) several times in the face,” the document states.
The next day, police learned that the victim suffered a “closed nasal fracture and subdural hematoma.”
Levonyak was charged June 17 with felonious assault in Struthers Municipal Court. She was arraigned June 18 and released from the Mahoning County jail after posting $5,000 bond.
She waived her preliminary hearing on the charge July 28, and the case was bound over to a Mahoning County grand jury. If convicted, Levonyak could get up to eight years in prison.
Also indicted was Timothy A. Esposito, 51, of the Mahoning County jail, on 40 felony charges: one count of engaging in a pattern of corrupt activity; 25 counts of grand theft; 10 counts of felony theft; and single counts of theft from a person in a protected class, trespass in a habitation when a person is present or likely to be present, grand theft when the property is a firearm or dangerous ordnance and one count of theft of drugs.
All of the charges are felonies. The engaging-in-a-pattern-of corrupt-activity charge is a second-degree felony punishable by up to eight years in prison. The other charges are lower level felonies.
Samuel Esposito, 36, of the Mahoning County jail was indicted on the same charges as Timothy Esposito in the same case and faces the same possible penalties.
The engaging in a pattern of corrupt activity charge alleges the offenses took place from March 8 through July 28.
