Appeals court upholds prison time in Struthers murder resentencing

YOUNGSTOWN — Even though the 7th District Court of Appeals upheld the convictions of Brandon L. Crump Jr., 22, in the Sept. 21, 2020, killing of 4-year-old Rowan Sweeney and shooting of four adults in Struthers, Crump was brought back to Mahoning County Common Pleas Court Tuesday to be resentenced.

The appeals panel said Judge Anthony D’Apolito should not have sentenced Crump separately on a complicity conviction related to convictions for aggravated robbery and aggravated burglary, even though fixing the error would “likely have no practical effect on (Crump’s prison) sentence.”

The ruling said D’Apolito needed to either “merge or vacate the conspiracy conviction.” D’Apolito changed the sentence to merge the sentence for conspiracy with the aggravated robbery and aggravated burglary convictions.

And he stated that it did not affect the length of Crump’s prison sentence, which is 52 years to life.

Crump was convicted at trial on all 14 counts in his indictment, including aggravated murder of Rowan, attempted murder of the adults, aggravated robbery, aggravated burglary and other offenses.

Two co-defendants also were sentenced to life prison sentences.

One is Kimonie Bryant, 29, who drove to a home in Struthers with Crump with a plan to rob a man of about $5,000 in cash. Rowan was on a couch with his mother, Alexis Schneider, at the time Crump entered the home through the front door at 1:51 a.m.

The other co-defendant is Andre McCoy Jr., 25, who was in the home at the time of the killing. He was himself shot in the face by the gunman and nearly died. He was complicit with Bryant in setting up the robbery.

Bryant and McCoy both entered guilty pleas. Bryant was sentenced to 20 years to life. McCoy got 15 years to life.
