Prosecutors request bond revocation for man arrested downtown

YOUNGSTOWN — Mahoning County prosecutors have asked Mahoning County Common Pleas Court Judge Anthony Donofrio to revoke bond for a young man charged with weapons offenses over the weekend.

Mahoning County Assistant Prosecutor Kyle Hilles asked Donofrio to revoke bond for Montand Mosley, 21, of Columbus, on a charge of being a felon in possession of a firearm, for which Mosley was indicted last month. The filing states that bond was set at $2,500 in that case.

They asked that his bond be revoked because, late Friday, he was with two other men in a car in a parking lot on Commerce Street downtown “sitting in the auto with no purpose to do business with any of the downtown businesses, which violates” the criminal trespass ordinance, a Youngstown police report states.

While talking to the occupants, officers saw two open cups, which is a violation of the open container law, according to the report.

Officers asked the three to exit the vehicle. Officers then found a loaded handgun on the floorboard of the vehicle. All three occupants were handcuffed.

The driver, Mosley, who was closest to the firearm, was charged with felony improperly handling firearms in a motor vehicle and being a felon in possession of a firearm, according to a Youngstown police report.

Mosley had been adjudicated delinquent for a high-level felony of improperly discharging firearms at or into a habitation in a 2020 juvenile case, meaning he is not allowed to possess a firearm, the report states.

Mosley was arraigned on the charges Monday afternoon in Youngstown Municipal Court and returns for a preliminary hearing on the two felony charges at 9:15 a.m. Aug. 18. He remained in the Mahoning County jail Tuesday morning in lieu of $15,000 bond.

“Defendant has clearly violated the terms and conditions of his bond set by this court, namely to obey all laws,” the filing in Donofrio’s court states.

“The state requests that the defendant be held without bond until these matters are concluded,” Hilles stated.
