Man pleads guilty to hitting student with car
16-year-old was walking near East High School
Staff report
YOUNGSTOWN — Herman Posey III, 47, of Gladstone Street, pleaded guilty Wednesday to felony vehicular assault and failure to stop after an accident for striking a 16-year-old East High School student with his car on Bennington Avenue on the East Side on Sept. 20. The student was walking on the road near the curb, police said.
Mahoning County prosecutors are recommending that Posey get two years in prison, but Posey’s attorney, Mark Lavelle, is free to argue for a lesser sentence. Posey will be sentenced at 10:30 a.m. July 29 by Judge Anthony Donofrio of Mahoning County Common Pleas Court.
The boy sustained serious injuries and was taken to St. Elizabeth Youngstown Hospital and was in stable condition later.
Police used school safety-zone traffic cameras and surveillance cameras to identify the vehicle and then arrest the driver.
