Boardman man indicted on aggravated burglary

YOUNGSTOWN — Lawrence L. Simon, 58, of Shields Road in Boardman, was indicted Thursday on aggravated burglary in a Feb. 4 confrontation in which Simon is accused of kicking in the door of an apartment in Simon’s same apartment building and being shot by the resident in self-defense.

Boardman police at the time stated that the man who fired the shots had not been charged, and police called him a victim who apparently acted in self-defense. Simon was shot in the leg, and another bullet went through the floor into the apartment below.

Simon, who has been in the Mahoning County jail since Feb. 6, could get more than 10 years in prison if he is convicted.

A Boardman police report stated that the resident reported that Simon had been texting the resident earlier that day, saying “weird” things. He reported telling Simon repeatedly to leave him alone. A while later, he heard slamming noises and thought Simon had slammed the main building door and the laundry room door, which is next to the resident’s apartment.

Then Simon texted him “get ready,” and the man heard another louder slamming noise, and got up out of bed to find Simon had kicked in his door, the report states.

Before Simon could walk too far into the apartment, the resident shot him in fear that Simon would harm him. The report states that Simon was taken to St. Elizabeth Youngstown Hospital for treatment while the man went to speak with police at the Boardman Police Department and other officers processed the scene.

The resident was later given a courtesy ride back home with no charges filed against him.

The report states that when police notified Simon he was being charged with burglary and handcuffed him to his hospital bed, Simon repeatedly ripped out IV lines and cables, took off his wound dressings and refused treatment. He told police he preferred to “bleed out” rather than be arrested, the report states.

Later that morning, police were called back to the apartment building after another resident living in the apartment below the apartment where the gunfire took place stated that there was a bullet hole in the bathroom wall.

Investigators followed a bullet hole from the upper shower wall through the shower curtain, through the bathroom wall and into a closet, where it had lodged in a plastic tote bag containing clothes. The bullet matched others police had found in the magazine of the resident’s handgun. Police again searched his apartment and found where the bullet had entered the floor, the report states.

● Jesse C. Bollinger, 40, Snyder Avenue, Struthers, cocaine possession.

● Cory E. Jackson, 50, Mahoning County jail, passing bad checks and forgery.

● Harold J. Reid, 58, Marmion Avenue, cocaine possession.

● Brooke R. Colao, 43, Garfield Drive, Elwood City, Pa., aggravated drug possession, heroin possession and fentanyl-related compound possession.

● Shamar J. Robbins, 30, Applecrest Court, Boardman, illegal use of Supplemental Nutrition Assistance Program benefits.

● Elvis S. Reyes, 39, South Portland Avenue, aggravated drug possession with a specification of forfeiture of money in a drug case.

● Anthony W. Kaczmark, age and address not available, two counts of harassment with a bodily substance.
