Trial begins in death of 2-year-old

YOUNGSTOWN — A jury was selected Monday in the courtroom of Mahoning County Common Pleas Court Judge Maureen Sweeney in the involuntary manslaughter and child endangering trial of Brianna Zagotti of Austintown.
Opening statements and first witnesses are expected at 9 a.m. today.
Zagotti, 31, is accused of causing the death of her nearly 2-year-old son July 6, 2023, through July 7, 2023, as a result of Zagotti committing or attempting to commit felony child endangering, according to her indictment. The felony child endangering accuses Zagotti of creating a substantial risk to the health and safety of the child by “violating a duty of care, protection or support” to the child, the indictment states.
An Austintown police report states that officers responded July 7 to the Compass West apartments for an unresponsive child. They found Zagotti and her boyfriend giving the boy CPR.
The boy was pronounced dead in the apartment, which is where he and his family lived, according to police. Austintown Detective Sgt. Lea Rozzo said that when police found no obvious signs of injury on the boy, testing was done that came back positive for the presence of fentanyl in the boy’s system.
The police report states that Zagotti and her boyfriend said there were no drugs in the apartment. Zagotti said her son was last seen in good health about two hours earlier. No narcotics were found in the apartment, police said. Rozzo said the child had been dead for a couple of hours before he was discovered.
If Zagotti is convicted of the charges, she could get more than 10 years in prison.
