Testimony in murder trial set to begin

YOUNGSTOWN — Testimony in the aggravated murder trial of Andre K. Bailey, of Craig Beach, will begin Wednesday morning after a full day of jury selection took place Monday in Mahoning County Common Pleas Court.

There will be no activity in the case today.

In addition to aggravated murder with a gun specification, Bailey, 40, faces charges of murder and aggravated robbery, both with a firearm specification, tampering with evidence and being a felon in possession of a firearm. Bailey has been in the Mahoning County jail since October.

Retired Trumbull County Common Pleas Court Judge W. Wyatt McKay is presiding over the trial as a substitute for Judge R. Scott Krichbaum, who was not available.

Bailey is one of six men charged either directly or indirectly in the Oct. 17 shooting death of Reynaldo Hernandez, 24, whose body was found Oct. 18 on Liberty Road near Wardle Avenue in the area of the Mount Hope Veterans Memorial Cemetery on Youngstown’s East Side.

Officials said they believe Hernandez was killed in a “drug house” on Bott Street on the East Side on Oct. 17. His body was found at the cemetery the next day. It is less than a mile from Bott Street.

Youngstown police went to the Bott Street residence at 6:47 p.m. Oct. 17 for a shooting, according to a Youngstown police report that did not provide many details other than detectives and crime scene investigators were called to the scene.

Vincent Marbley, 59; and Eddie Winphrie, 41, both face the same charges as Bailey. Three other men were indicted on other charges in the case — Daniel Ramsey, 43, of New Castle, Pa., on involuntary manslaughter with a gun specification and tampering with evidence; Shawn Jones, 35, on one count of tampering with evidence; and Richard W. Lightner, 40, on one count of tampering with evidence.

Ramsey, Jones and Lightner pleaded guilty to various charges in the case in early January.

Prosecuting the case is Mahoning County Assistant Prosecutor John Juhasz, chief of the criminal division; and Assistant Mahoning County Prosecutor Katherine Jones.

This is the first trial for Juhasz as chief of the criminal division after a long career mostly serving as a defense attorney. Lynn Maro, also a former defense attorney, hired Juhasz to work in the prosecutor’s office after she was elected Mahoning County prosecutor Nov. 5.

Bailey’s attorney is Walter Madison.
