Elkton inmate serving 20 years is indicted again

YOUNGSTOWN — Jonathan D. Kindrick, 38, a federal inmate, was arraigned Monday in U.S. District Court in Youngstown on new charges of possessing child pornography and possessing contraband in prison for offenses alleged to have occurred at the Elkton federal prison in Lisbon.

Magistrate Judge Carmen E. Henderson presided over the hearing, and David Toepfer, assistant U.S. attorney, was present on behalf of the government. Kendrick was remanded to the custody of the U.S. Marshals Service.

Kendrick’s indictment, handed down July 10, alleges he possessed six SD cards and a cellphone that contained child pornography, which had been shipped and transported in interstate and foreign commerce. The offenses occurred Sept. 29, 2023, and at least one image involved a child less than 12 years old, the indictment states.

The other offense — possessing contraband in prison — also occurred Sept. 29, 2023, at the Elkton Federal Correctional Institution, the indictment states.

Kendrick is set for a final pretrial at noon Oct. 22 and a jury trial at 9 a.m. Oct. 28 in Cleveland federal court, both in front of U.S. District Court Judge Charles E. Fleming.

Kindrick has been serving a 20-year federal prison sentence since June 2011. The offense that sent him to prison was possessing child pornography, according to a 2011 news release from the U.S. Attorney’s Office for the Western District of Missouri.

Kindrick, then 25, and of Kansas City, also was sentenced at that time to serve the rest of his life on supervised release following incarceration. Kendrick was “diagnosed as a pedophile” and was a registered sex offender at the time he committed the offenses in Missouri, according to the 2011 news release.

On Aug. 25, 2010, Kendrick pleaded guilty to possessing child pornography, the release states. In December 2008, Kendrick began living at the Kansas City Honor Center, a halfway house, while on state probation for a child pornography conviction, the release states.

Kindrick failed to return to the Honor Center Feb. 28, 2009, after being given leave to attend to medical concerns.

When Kendrick returned to the Honor Center on March 4, 2009, he was placed in lockdown and then arrested for probation violations, the release states.

Honor Center staff examined Kindricks’ cellphone and found images of child pornography. Forensic investigators found eight images of child pornography on the cell phone.

The court also ordered Kindrick to forfeit to the government the cellphone that was used to commit the offense.
