Columbiana County resident files lawsuit against LaRose

Says Harris should not be on ballot

LISBON -- Don Vos, a longtime member of the Columbiana County Unorganized Militia, is challenging the constitutionality of Vice President Kamala Harris replacing President Joe Biden on the Ohio ballot for president.

Vos, of Hazel Run Road, Hammondsville, filed the case in U.S. District Court in the Northern District in Youngstown on Aug. 1 against Ohio Secretary of State Frank LaRose, seeking a temporary restraining order and / or permanent injunction questioning the ability of Harris to take Biden's spot in the election in Ohio.

"As Joe Biden bowed out of the race for president, the only two people that can be in the race for president for 2024 can be Kennedy and Trump," the document states, referring to Robert F. Kennedy Jr. who's running as an independent, and former president Donald Trump, who's the Republican candidate.

Vos said in the filing that there's no place in the Ohio constitution that allows for Harris or any other Democrat to replace Biden.

The case has been assigned to Judge Dan Aaron Polster. No hearing dates have been set.

Vos also filed a motion to file the lawsuit "in forma pauperis," saying he falls under the federal poverty guidelines and should be able to file without paying any fees.

Harris is considered the presumptive nominee, with the Democratic National Convention planned for later this month in Chicago, Ill.
