Man accused of overdosing in front of his daughter, 7

AUSTINTOWN — A man accused of overdosing in front of his 7-year-old daughter is scheduled for a preliminary hearing Aug. 7.

Michael Marks, 45, of Navarre Avenue, was arrested after a neighbor found his daughter standing in the backyard, crying because “daddy won’t wake up.”

Marks appeared last week in Mahoning County Austintown Court, charged with abusing cocaine and fentanyl, both separate felony counts; and misdemeanor counts of endangering children, possession of drug abuse instruments and possession of drug paraphernalia.

He pleaded not guilty to the misdemeanor counts and acknowledged the felony charges against him. Judge Scott Hunter imposed a $5,000 cash or surety bond for the felonies and $3,000 recognizance bond on the misdemeanors.

The police report states that officers responded to the home around 8:45 p.m. July 14 and the neighbor escorted them into Marks’ kitchen, where he was lying on the floor unresponsive, with labored breathing.

The report states the officer was unsuccessful in trying to revive him with Narcan, and Marks did not wake up until Lane paramedics arrived and used more aggressive resuscitation efforts.

The report states the neighbor had followed the girl into the house and found Marks unconscious in a kitchen chair and then moved him to the floor to begin CPR.

The report states that police found apparent drugs in a piece of paper on the kitchen table, powdered drug residue on the table, a syringe filled with a dark-colored liquid, a crack pipe, and loose syringes, all within easy reach of the girl.

The report states the girl told police she was watching shows on her iPad and after she was done, she went to find her father, and panicked when he would not wake up.

“I even punched him in the cheek and he would not wake up,” she told police.

When Lane’s revived Marks, he declined further medical treatment, and police arrested him.
