Man faces OVI charge after traffic stop

CAMPBELL — A Beaver Township man is due in Campbell Municipal Court Friday for arraignment on an OVI charge. Campbell police said the man was caught with alcohol and three loaded guns in the vehicle.

According to a police report, an officer Tuesday pulled over Joshua D. Frankos, 34, on Wilson Avenue in Campbell for allegedly speeding.

The officer states in the police report that he smelled alcohol as he approached the vehicle, so asked Frankos if he had been drinking. Frankos repeatedly denied it and declined to take a field sobriety test, the report states. He also denied having any weapons in the vehicle.

The report states the officer called for backup, but before other officers arrived, Frankos got out of his vehicle, and the officer told him he would be arrested if he did not submit to the testing. Another officer arrived and Frankos submitted to the tests, which police said he failed, the report states. The testing officer told the first he did not believe Frankos could operate the vehicle safely, the report states.

The report states police searched the vehicle and found a loaded revolver under the center console, and a partially full beer can that was “cold to the touch.” The police found two other loaded guns and asked the passenger if any of the items belonged to her, the report states. She said they did not. When the police placed the guns on the ground in front of the police cruiser, Frankos admitted they were his, the report states.

At the police department, Frankos submitted to a breath test, which showed a blood alcohol content of 0.135%, the report states. The legal limit in Ohio is 0.08%.

In addition to the OVI count, Campbell Municipal Court Judge Patrick Cunning will hear Frankos’s pleas to charges of speed, disobeying a stop sign and possession of an open alcohol container.

Court records do not show Frankos under any legal disability that would bar him from possessing firearms.
