Judge declares mistrial in attempted murder case
YOUNGSTOWN — The attempted murder trial of Marco Cardenas, 34, a state prison inmate, was declared a mistrial Tuesday, meaning that it could not continue. It has been reset for Nov. 7 with a new jury.
Court officials would say only that it had to be declared a mistrial because of a specification in Cardenas’ indictment.
Cardenas went on trial starting Monday in Mahoning County Common Pleas Court on charges that could lead to decades more of prison time. Judge Anthony D’Apolito presided over the trial.
Cardenas was indicted in March on charges of possession of a deadly weapon with a notice of prior conviction, attempted murder with a criminal-gang-activity specification and repeat-violent-offender specification, felonious assault with a criminal-gang-activity specification, notice of prior conviction and repeat-violent-offender specification, and possessing criminal tools.
On March 29, 2021, he is accused of making a makeshift knife while in the Ohio State Penitentiary in Youngstown and trying to kill another man. He is also accused of being a repeat violent offender.
Another trial began Monday in the courtroom of Judge Maureen Sweeney. Dale E. Kennedy, 40, of Lauderdale Avenue in Youngstown, is on trial on several mid-level felonies, including tampering with records and having weapons while not allowed, plus lower-level felonies of aggravated drug possession and drug possession.
If convicted, he could get more than six years in prison. A jury deliberated Tuesday, but they were sent home for the day in the late afternoon to return today to resume.
