YOUNGSTOWN — A judge has shut down further festivities in a homeowner’s dispute with Boardman Township over a pool party at 8383 Glenwood Ave.

Judge R. Scott Krichbaum, in a Mahoning County Common Pleas Court ruling Monday, found such advertised use of the property a “public nuisance” because of excess noise, light, crowd and parking — and said it

Taylor A. Moore, 30, of Glenwood Avenue in Boardman, is one of the people involved in the Memorial Day pool event that Boardman officials said resulted in parking problems, noise and trash left behind, and a zoning violation.

The township asked that Moore, Michelle Firman and Malcolm A. Carter be prohibited from using the property again as a “luxury pool party event center.”

The judge ruled the home is located in a residential area, and the township’s zoning laws prohibit its commercial use. Charging an entry fee would violate the township’s zoning laws.

The ruling states defendants can’t rent or lease the property for any public social gatherings and are permanently prohibited from advertising, scheduling or hosting social gatherings for profit.

Moore claimed that she was using a social media app to rent her pool to people. The complaint mentioned that Moore advertised event booking and a “one epic pool party” event.

The defendants also claimed this was an “equal protection case,” stating Boardman allows Airbnb and Vrbo-type short-term rentals. Krichbaum noted such establishments are subject to a conditional use classification.

Boardman Township had first sought a preliminary injunction in court.

Previously, the township and the three people agreed in a court document that use of the home for large party rentals is not permitted under the R-1A Single Family Residential District zoning resolution.
