SOBE given deadline to file documents with commission

YOUNGSTOWN — SOBE Thermal Energy Systems LLC has until June 16 to file the necessary paperwork with a state regulatory agency to comply with a 2021 order that allowed the company to acquire Youngstown Thermal LLC and Youngstown Thermal Cooling LLC.

SOBE has more than 40 customers in the downtown area as well as Youngstown State University.

The Public Utilities Commission of Ohio has ordered the Dublin, Ohio-based company to provide proof the transaction closed, and documents related to the transfer of assets and customers, according to the latest order in the case.

SOBE is also ordered to cooperate with the commission to provide it information to fully transfer tariffs and appropriate listing and recognition that SOBE is a public utility in Ohio, the order states.

The matter was before the commission Wednesday. It also ordered tariffs from Youngstown Thermal LLC and Youngstown Thermal Cooling LLC be transferred to SOBE, and to close the 2017 enforcement case against the heating and cooling companies.

David Ferro, SOBE chief executive, said the company is in the process of applying for new rates that are “significantly lower than the current customer rates,” and once approved, will be effective following upgrades to the system.

The items are part of a case that goes back to 2017, after the commission was informed by Youngstown Thermal’s former CEO the business was in a financial struggle that could have caused an energy crisis downtown. The company couldn’t ensure adequate service to its customers and was in danger of insolvency when the commission stepped in, asking the company be placed in receivership.

The commission in November 2021 approved the sale of the companies to SOBE, which had managed the facility since June 2019. The sale was for $250,000.
