Sex offense nets city man 2 years

YOUNGSTOWN — Mark Burney, 57, of Breaden Street, was sentenced to two years in prison Thursday and is classified as a Tier-2 sex offender.

His case was indicted in 2019 as rape, but it resulted in a guilty plea in January to a much lower-level felony of gross sexual imposition.

Judge Anthony Donofrio of Mahoning County Common Pleas Court sentenced Burney after Burney pleaded guilty to gross sexual imposition Jan. 13. Two years is the sentence prosecutors and the defense jointly recommended.

Burney gets credit for 280 days spent in the Mahoning County jail awaiting trial. Two counts of rape are being dismissed as part of the plea.

The victim was about 8 to 10 years old at the time the offense took place between 2013 and 2016, according to court documents.

A woman also was indicted with Burney, but those charges were dismissed in 2021.
