WARREN -- An off-duty Youngstown detective was traffic stopped last week by the state patrol and arraigned Tuesday in Warren Municipal Court on charges of improper handling of a firearm in a motor vehicle, operating a vehicle while intoxicated and operating an illegal vehicle on the highway.
The charges are in connection with an citation given by an Ohio State Highway Patrol trooper after stopping an ATV-side-by-side off-road vehicle at the corner of North Leavitt and North River roads on the evening of Sept. 9.
Nicholas Bailey, 35, of Garrettsville, pleaded not guilty to the charges through his attorney, Frank Cassese, according to court records. He was released on a personal bond and will face an Oct. 12 preliminary hearing before Judge Terry Ivanchak.
Bailey is a detective sergeant with the Youngstown Police Department.
According to the report from the highway patrol, a trooper saw a side-by-side ATV back out of a driveway on North Leavitt Road about 9:25 p.m. to follow two ATVs as they turned eastbound on North River Road from North Leavitt. After initiating the traffic stop of the side-by-side, the driver -- identified as Bailey -- stated he thought he could ride on the road if it was a 35 mph zone and he was going to a trail entrance.
The detective told the trooper he was a Youngstown police officer and informed him he had a weapon in the vehicle. The trooper found a loaded Glock 9 mm with a full magazine in the glove box of the vehicle. The detective also refused to do a sobriety test, the report states, and later refused a Breathalyzer test.
The report stated another trooper chased the other ATVs, but they turned off the road and fled.
