YOUNGSTOWN -- A Campbell man was arraigned Wednesday in Mahoning County Common Pleas Court on three felony charges stemming from the July 31 slaying of a 46-year-old East Philadelphia Avenue man.
John Morgan, 45, of 669 Penhale Ave., remained free after posting a $500,000 bond on Aug. 9. The bond was continued after his attorney, Scott Cochran, entered a not guilty plea for him during arraignment. The case was assigned to Judge Maureen Sweeney with a trial set for Oct. 17.
The charges -- two counts of murder and one count of felonious assault -- carry a penalty of 15 years to life in prison if Morgan is convicted.
Morgan is accused of killing a man he knew, Daniel A. Peek Sr., in the 1400 block of East Philadelphia Avenue on the South Side, a police report states. The call came in at 12:16 p.m. July 31.
When Youngstown police officers answered the shooting call at the East Philadelphia Avenue home, they found Morgan standing next to a purple and black Dodge Charger with his hands in the air. The man matched the description of the suspect that was given to police, the report states.
Morgan told police officers the gun was on top of the car, and he was taken into custody. A gun holster was on his hip and that was taken into evidence along with Morgan's cellphone, keys and wallet, the report states.
The gun was found on the roof of the Dodge Charger with the bullet magazine released from the weapon and a single bullet next to the firearm, the report states.
Morgan was indicted for the murder Aug. 26 by a county grand jury.
OTHER CASES
Jeremy E. Telego, 40, of Columbiana Road, New Springfield, pleaded not guilty to kidnapping, felonious assault, abduction and aggravated menacing charges.
Telego, who also faces a parole violation, remains in Mahoning County jail pending the posting of a $35,000 bond. A trial tentatively has been set for Sept. 26 before Judge R. Scott Krichbaum.
Telego was arrested July 18 at the Boardman Inn, 7109 Market St., on warrants stemming from incidents days before where he is accused of holding a woman against her will and assaulting her at the Wagon Wheel Motel, 7015 Market St. The woman told police she had been at a concert July 16 with Telego, who became intoxicated.
According to the report, the couple argued on the way to the motel, and then he pulled her out of the car and dragged her across the motel parking lot into a room. He also would not let her leave and assaulted her, the report states. When Telego fell asleep, the woman escaped through a bathroom window and was treated at a hospital for body bruises and an injury to her ear.
At the arraignment, Telego was ordered not to have contact with the woman if he posts bond.
In another arraignment Wednesday, Christopher Sherman, 19, pleaded not guilty to five counts of felonious assault in connection to a July 19 shooting of a girl, 15, in a car on Clearmount Drive on the South Side. Three other people also were in the car, but were not injured.
Sherman, who is being held pending the posting of an $180,000 bond, was ordered not to have contact with the victims in the case if he is released. A trial was set for Oct. 11 before Judge Anthony Donofrio.
