Man charged after fleeing police

YOUNGSTOWN — Cesaire K. Penny, 30, of Lakewood Avenue is charged with misdemeanor failure to comply after an incident Sunday on Ridge Avenue, in which he is accused of fleeing from a Youngstown police officer and twice striking the officer’s cruiser.

A Youngstown patrolman went to a home in the 1000 block of Ridge for what was reported to be an abandoned vehicle at an abandoned house.

When the officer got there, he found a man and woman in the back seat of the car, which was a newer model Kia. It appeared they were engaged in sexual activity, the officer stated in a report.

The officer told the two to get dressed and asked the man if the car belonged to him because there was no license plate. As the officer wrote down the vehicle identification number, Penny became confrontational, asking why the officer was writing down the VIN.

The officer returned to his cruiser to request assistance from other officers and to check the status of the vehicle, and Penny started to back up the car in the driveway, striking the front corner of the cruiser.

It then struck the cruiser a second time and made it into the street, then turned onto Glenwood Avenue and turned on several other roads and got away.

Officers went to the address for the vehicle on Lakewood Avenue but did not find the vehicle.

On Monday, an officer patrolling on Lakewood Avenue spotted the Kia in Penny’s driveway with damage on the passenger side. Two officers approached the vehicle and found Penny in the driver’s seat with the engine running.

Police took Penny into custody. Penny stated “that cop hit me” and “that cop was going too far, and there was no need to check my VIN,” the police report states.

Penny will be arraigned today in Youngstown Municipal Court.
