City resident facing gun charges

YOUNGSTOWN — A city man was arrested Friday and is expected to appear before U.S. Magistrate Carmen Henderson on Thursday for a preliminary hearing on firearms charges filed after the FBI searched his residence on Matta Avenue on Jan. 5.

Daniel May, 29, is set to appear in federal court on charges of being a felon in possession of firearms as a result of the FBI search. May was not in the home at the time of the search. However, due to a several month surveillance of the property, it is believed he lived at the Matta Avenue residence.

He was previously convicted on March 20, 2014, on a charge of possession of cocaine in Mahoning County Common Pleas court, and on Dec. 3, 2015, May was convicted of trafficking in heroin and tampering with evidence.

Due to the two prior convictions, May is not allowed to have firearms in his possession.

The FBI established the Matta Avenue residence as May’s home through a database used by law enforcement, which indicated May began using it as his home in April 2021. In addition, he was observed entering the residence on Nov. 7, 2021, and on April 25, 2022. He was seen sitting on the property’s front porch on Nov. 21, 2021.

In addition to finding the weapons in the residence, an FBI lab analysis of the weapons established a high probability that May handled them.

According to an affidavit filed in U.S. District Court on Wednesday, FBI agents obtained a search warrant of the Matta Avenue residence from U.S. Magistrate Judge George J. Limbert on Jan. 2, 2022. The search of the home was based on the FBI’s belief that crack cocaine, heroin and cocaine were being distributed from the residence. Telephone and other communication devices were being used to distribute the drugs, the affidavit states.

During the search, agents found suspected crack cocaine in the second floor toilet and a white powder substance on the bathroom floor around the toilet. A Bureau of Criminal Investigation lab analysis of the hard substances found in the toilet indicated it was three grams of a mixture containing cocaine. The substance found on the floor was 1.74 grams of a mixture containing Tramadol, cocaine, heroin, para florofentanyl and fentanyl, the affidavit states.

In addition, agents found 53.04 grams of a cutting agent in a kitchen cabinet, a digital scale with white powder residue in a drawer in the dining room and a kilogram press with white residue in a cabinet drawer located in the dining room.

Law enforcement officers also found a Smith & Wesson Model M&-15 rifle leaning against the bedroom’s nightstand, a Springfield Armory, Model Hellcat 9 mm pistol on a heating and air conditioning unit next to the bed, as well as a Glock model 430, 10 mm pistol on the floor next to the bed, the affidavit states.

Additional ammunition and multiple magazines, including a high-capacity loaded magazine, were found in the basement.

Multiple identification cards, including a health insurance, two debit cards and an academic transcript with May’s name on them were found in the bedroom, the court document states.
