Cafaro, Regal Cinema, others sued in wrongful death case

WARREN — A relative of a Niles woman who died after she was injured falling off the ramp at the Boulevard Center Cinema in December 2019 has filed a wrongful death complaint against the owners of the Regal Cinema and the Cafaro Company, landlords of the Eastwood Mall Complex.

A lawsuit was filed Thursday by John Landolfi, executor of the estate of the late Jennie Landolfi of Niles, against Regal Cinemas Inc. and the Cafaro associates who operated the Boulevard Center cinemas. The action seeks a jury award of at least $25,000 in damages.

According to the document, the owners of the cinema property failed to maintain the handicap ramp in a safe and lawful condition, which led to the Dec. 6, 2019, incident that caused Jenny Landolfi’s injuries and ultimate death.

The document states the operators of the property failed to provide adequate lighting near the ramp and failed to provide clear markings for the curb edge at the ramp’s lower landing. The ramp also did not have a guard at the curb edge to prevent a wheelchair from toppling over. Handrails on the ramp were also at an inconsistent height and did not extend at least 12 inches beyond the bottom of the ramp. The lawsuit claims the ramp was in violation of

Ohio building codes and ADA guidelines.

The lawsuit claims Jennie Landolfi suffered serious injuries as she exited the ramp and her wheelchair toppled over the curb into the road. She died May 15, 2020.

Joe Bell, spokesman for the Cafaro Company, said the company’s legal department has not yet been served with a copy of the lawsuit.

“Therefore, they haven’t had the chance to examine the claims it contains,” Bell said. “I’m afraid there is no way I am able to comment on it at this point.”

The case has been assigned to Trumbull County Common Pleas Judge Andrew D. Logan, who has not scheduled any hearings.
