Sentencing set in Boardman assault

YOUNGSTOWN — Shawn Drogus, 31, of Shenango Street in New Castle, Pa., will be sentenced at 9:30 a.m. Jan. 11 after being convicted at trial of assaulting two Boardman police officers, obstructing official business, resisting arrest and disorderly conduct.

The jury found him not guilty of the most serious charge, felonious assault on Sgt. Glenn Patton of the Boardman Police Department, but the jury found him guilty of the lesser charge of felony assault on Patton.

Judge Anthony Donofrio of Mahoning County Common Pleas Court will hand down the sentence. The judge revoked Drogus’ bond after the guilty pleas were read, and Drogus was taken to the Mahoning County jail, where he remains.

The felonious assault charge accused Drogus of causing serious physical harm to Patton by kicking Patton in the chest while fighting with Patton and two other Boardman officers. The felony assault conviction is for causing or attempting to cause or recklessly causing serious physical harm to Patton.

Patton suffered bruising to his ribs and an injury to his hand and wrist area that put him on light duty for a couple of months. He also had injuries to his elbow and head. He returned to work on light duty some weeks after the assault.

Though Drogus was accused of assaulting three Boardman officers, the jury did not find him guilty of assaulting one of the three.

A cellphone video of the incident filmed by Drogus’ twin brother was played repeatedly during the trial, including the final day of the trial, when Drogus took the witness stand and testified that he “blacked out” and did not remember assaulting Patton after he was “hit in the face.”

When police arrived at the Days Inn, they found a woman and Drogus, who was staying with his family at the Holiday Inn across U.S. South Avenue from the Days Inn.

The woman was holding her stomach as she cried. Drogus was there trying to talk to her. When officers told him they would handle the situation, Drogus became uncooperative and appeared to be intoxicated or under the influence of a substance, police said.

After being arrested, Drogus became combative, taking on a “fighting stance,” according to a police report. He continued to resist, pushing officers and elbowing then kicking Patton in the chest, the report states.

The video shows that Drogus was on the ground when he swung his leg and kicked Patton, who then fell back onto the ground.

When Drogus testified, he said he made a mistake by not cooperating with police when they asked him to leave the area.
