Niles man pleads to reduced charges

WARREN — A Niles man originally charged with two rape counts has pleaded guilty to reduced charges connected to a Nov. 22, 2020, incident at a Weathersfield home.

David J. Kennedy, 33, of Nebraska Avenue, pleaded guilty to charges of felonious assault and sexual imposition. Trumbull County Common Pleas Court Judge Andrew D. Logan is expected to sentence Kennedy after he undergoes a background investigation conducted by the adult probation department.

Kennedy faces a sentence of 8 and 12 years and will be labeled a Tier 1 sexual offender. As a sex offender, he will be required to register his addresses with the local sheriff’s office once per year for 15 years.

The plea deal headed off a jury trial that was scheduled Oct. 4 before Logan.

The case involves a Nov. 22, 2020, incident at a Lakeside Way residence in Weathersfield. A caller told a 911 dispatcher that a 27-year-old man was awakened to find himself being sexually assaulted. The assailant, who was identified on the 911 report as Kennedy, was not there at the time of the call, which came at 1:05 p.m.

Records show Kennedy has been in the Trumbull County jail since April 24, pending the posting of a $75,000 bond. If he is released, Kennedy is ordered not to have contact with the victim.
