WARREN — A Howland woman has sued a Youngstown-based real estate company, a broker, a real estate agent and a Girard resident.

She accuses them in a court filing of illegally closing a transaction for her Robbins Avenue, Niles, property and illegally entering the property and committing damage in excess of $30,000.

A lawsuit was filed last week by attorney Daniel P. Thomas of Warren, representing Karen Macali of North Road NE. The case was assigned to Trumbull County Common Pleas Court Judge Andrew D. Logan.

Logan has not scheduled hearings in the case. The court docket shows the defendants were served the lawsuit as of April 26.

Named as defendants are Jabbe’s 6 Inc. — doing business as RE / MAX Valley Real Estate of Youngstown — its broker Kenneth Burton, real estate agent Sonja Ezzo and Tyler M. Stoddard of Girard, who had contracted to purchase Macali’s Robbins Avenue home in March.

RE / MAX Valley Real Estate’s main office is located at 1040 S. Commons Place in Boardman.

Attempts to reach RE / MAX Valley Real Estate, the broker and the agent by both email and phone calls were unsuccessful.

The complaint seeks damages in excess of $30,000 plus interest, attorney fees, costs and other relief the judge deems equitable, the lawsuit states.

According to the filing, Ezzo and Burton, who work for RE / MAX, represented Stoddard as his agent in the deal to purchase the 706 Robbins Ave. property for $160,000. Stoddard had deposited $1,000 with RE / MAX and the contract for sale was to be closed by March 25, 2021, the suit states.

On March 27, before the transaction was closed and the property legally transferred and recorded, the suit alleges Ezzo, with the approval of Burton, gave Stoddard illegal access and possession to the Robbins Avenue property.

The defendants “were negligent in allowing an illegal entry to the property and breached” the contract, the lawsuit states — adding that the defendants were liable for the damages incurred.

Thomas in the lawsuit seeks a jury trial. According to the Trumbull County Auditor’s website, Macali still owns the property.
