Fraud trial of Youngstown attorney will be in March
YOUNGSTOWN — The trial of a Youngstown attorney and another man charged federally with millions of dollars in income-tax fraud has been postponed from Nov. 30 to 9 a.m. March 22, 2021.
The defendants are attorney Robert J. Rohrbaugh II, 46, who lists an office at 200 Belmont Ave., and Terris C. Baker, 49, of Canton.
The defendants both asked for the trial to be postponed, citing concerns related to the COVID-19 pandemic and their attorneys’ need for additional time to prepare for trial.
The attorneys stated that there is an extensive amount of pretrial evidence to review, including tax returns, transcripts, audio telephone calls, 1,490 pages of bank records, 373 pages of emails and 1,242 photos.
Attorneys for the defendants have “needed experts to aid in the understanding of the tax records,” Judge Benita Y. Pearson stated in her judgment entry this week.
Defense attorneys also seek technical staff to aid in the preparation and presentation of the case at trial, the judge added.
She set a final pretrial conference for 1:30 p.m. March 9.
Rohrbaugh, who has pleaded not guilty and is represented by attorney Samuel Amendolara, remains free on bond. Youngstown man Brandon R. Mace, 43, of Youngstown, was indicted originally in the case but was listed in a recent superseding indictment as “named but not charged.”
Among other things, Rohrbaugh is accused of knowingly failing to report all of his income for 2015.
The government alleges that from about January 2015 to about September 2015, the defendants conspired to submit fraudulent federal income tax returns in the names of various fictitious entities to the IRS in order to obtain refunds. One government refund check totaled $1.35 million in the name of a fictitious business called Speed Werks LLC, the government alleges.
A recent superseding indictment lists seven fraudulent tax returns Mace caused to be filed totaling about $9 million in refunds requested.
Federal prosecutors allege Baker paid Rohrbaugh $150,000 in 2015 for the legal work Rohrbaugh did in connection to the enterprise.
