Condo owners file suit

City of Canfield, association blamed for flooding issues

YOUNGSTOWN — Owners of a condominium in the Hunter’s Woods Condominiums of Canfield have filed suit against the city of Canfield and their homeowner’s association over flooding that damaged basements May 28, 2019.

Those who separately filed the suits are Barbara Pizzola of Meadow Lane in Youngstown, Judith Connors of Town Square Boulevard of Columbiana and George Yuhas of Hunter’s Woods Boulevard in Canfield.

They have owned or lived at 18C Hunter’s Woods Boulevard, the suits state. The association is called the Hunter’s Woods Homeowner’s Association and is located at 22 Hunter’s Woods Boulevard, the suits state.

The suits allege the city constructed, maintained and / or designed and operated the sewer system that serves the condominium unit.

The condominium flooded, causing significant damage when water, dirt, untreated sewage and other materials got into the basement, the suit states.

The suit alleges that defects in the maintenance of the sewer system allowed groundwater to get into the sewage system, overloading it and causing the flooding.

The water caused structural damage to the condominium, destruction of personal property, bad smells and costs associated with the cleaning and the need to sanitize the properties. The damage also diminished the value of the properties, the suit alleges.

The city “failed to take reasonable steps in a reasonable amount of time to repair, correct or remedy the defect,” the suit filed by Pizzola states.

A call to city Manager Wade Calhoun was not returned.

It is unclear from the lawsuit what role the association played in the flooding. A call to the attorney filing the suit, Kim Akins of Youngstown, was not returned. No phone number for the association could be found.

The suit asks a judge to declare the city and the homeowner’s association liable for at least $25,000 in damages and also to award exemplary damages.
