Judge rules defendant’s untruthfulness did not void plea agreement

YOUNGSTOWN — After listening today to one witness and oral arguments from prosecutors and defense, Judge Anthony D’Apolito of Mahoning County Common Pleas Court ruled from the bench this morning that defendant Kimonie Bryant, 27, did not breach his plea agreement by being untruthful about certain things in plea discussions with prosecutors.

The ruling means that the plea agreement prosecutors reached with Bryant remains in effect and prosecutors will not be free to recommend that Bryant get more than 20 years to life for his role in the 2020 killing of 4-year-old Rowan Sweeney in a home in Struthers.

Bryant remains set for sentencing July 10.
