Opposing views aired in opening statements in murder trial

YOUNGSTOWN -- Assistant Prosecutor Rob Andrews said today in opening statements in the John Morgan murder trial that the fight between defendant John Morgan and Daniel A. Peek Sr. that resulted in Peek being shot and killed outside of Peek's home on East Florida Avenue was not self defense.
After Morgan fired a shot into the ground and a physical altercation took place involving Morgan, Peek and Peek's son, Daniel Peek Sr. was running away from Morgan and was a car length away when Morgan fired a shot hitting Peek in the back. Peek died later from the injury.
But defense attorney Brandon Henderson told the jury that it's important to know the health problems Morgan has had over the years and to know that Morgan had a dash camera in his car, filming the episode because Morgan had been the victim of 18 gunshots being fired from a car next to him one day in Youngstown.
And when Peek's son jumped in to help his father the day of Peek's death, Morgan felt that his life "was in imminent danger."
The trial resumes later this morning.
