Wed. 11:58 a.m.: Leetonia man pleads guilty in drunk driving crash

YOUNGSTOWN — David Z. Kelly, 38, of Lisbon Street in Leetonia, pleaded guilty this week to aggravated vehicular assault and drunken driving in a 5:21 p.m. Feb. 3 crash on state Route 46 in Beaver Township.

The charge is a third degree felony, punishable by about three years in prison, but prosecutors and the defense in Mahoning County Common Pleas Court are jointly recommending that Kelly spend one year in prison. He will be sentenced at 11 a.m. Sept. 27 before Judge R. Scott Krichbaum.

According to an Ohio State Highway Patrol crash report, Kelly was northbound on Route 46 near state Route 11 and drove left of center, striking the front of a southbound vehicle.

An alcohol test drawn at the hospital, where Kelly was taken for injuries, showed that he had a blood alcohol level of .256, which is more than three times the legal limit in Ohio to drive of 0.08, according to the report.

The driver of the other car, Martha A. Lopez, 71, of Canfield, suffered serious injuries to her wrist in the crash and was taken by ambulance to St. Elizabeth Youngstown Hospital. The wrist required surgery, prosectors said.

A passenger in her car, Ismael Lopez, 77, also suffered bumps and bruises but not as serious as the driver, prosecutors said.

Kelly was indicted on two additional charges that were dismissed in exchange for his guilty plea.
