4th investor sues Lordstown Motors

LORDSTOWN — A fourth investor in Lordstown Motors Corp. has sued the company, claiming, like the others that have taken the electric truck startup to court, that it misled investors regarding preorders of its truck, the Endurance.

The latest lawsuit, filed by Jesse Brury in federal court in Youngstown, also names company CEO Steve Burns; Rich Schmidt, president; and Julio Rodriguez, chief financial officer.

The allegations in court come after New York City-based Hindenburg Research, a financial investment research firm known for actively short-selling stocks, released its stinging report on Lordstown Motors, claiming LMC misled its investors regarding preorders and the production schedule for its battery-powered truck.

The March 12 report also characterized the company as a mirage.

In his lawsuit, Brury’s claims are similar to those in Hindenburg’s report — the company did not disclose the preorders were nonbinding, many of the customers lacked the means to buy the trucks, and the company is not on schedule to start production in September.

The first two lawsuits have been combined.

On Monday, the company released a video on social media of three Endurance beta prototypes being loaded onto a truck outside the company’s manufacturing plant in Lordstown on their way for testing.

Two weeks ago, LMC publicly revealed the first two beta prototypes of the Endurance. The betas will be used for crash, engineering and validation testing.
