Man ruled competent in murder case

YOUNGSTOWN — After four evaluations, a judge in Mahoning County has found Johnnathen D. Figueroa, 21, of Sherwood Avenue, competent to stand trial Nov. 4 in a murder case.

Figueroa is one of three men charged in the July 2017 murder of Marion Bugdal, 52, on Bennington Avenue. The others are Alex New, 22, and Fred Nolasco, 21. Nolasco, however, was found incompetent to stand trial.

Bugdal was found in the remains of his burned-out home on the East Side a couple of days after he was killed. Police have said they think Bugdal was killed during a failed burglary attempt.

Prosecutors have said New was the triggerman, and that he told the others they were going to Bugdal’s house looking for gold bars, the Tribune Chronicle’s broadcast partner, WKBN TV-27, has reported.

At a hearing Wednesday before Judge Maureen Sweeney, assistant Prosecutor Rob Andrews said three evaluations were conducted on Figueroa before Judge Sweeney declared Figueroa incompetent to stand trial in April. But officials at Heartland Behavioral Healthcare later determined he had been restored to competency.

Figueroa’s attorney, Mark Lavelle, asked for another evaluation in August, which showed that Figueroa is competent, Andrews said. Lavelle said he would agree that those are the facts with the understanding that Figueroa would be ruled competent to stand trial and that Lavelle and Andrews would work toward a negotiated resolution to Figueroa’s case.
