Felony charge goes to grand jury

Former 1st-round pick released on $4K bond; 2 counts dropped

YOUNGSTOWN — Cleveland Cavaliers guard Bryan Kevin Porter Jr.’s felony charge of improper handling of a firearm in a motor vehicle was bound over to a Mahoning County grand jury Wednesday.

Porter, 20, of Cleveland, appeared in Austintown Area Court on Wednesday morning with two attorneys and waived his preliminary hearing on the charge, a fourth-degree felony punishable by up to 18 months in prison.

The charge arose after Porter crashed a silver 2020 Mercedes Benz on Interstate 76 in Milton Township about 2 a.m. Nov. 15. Porter was not injured and was walking around when Ohio State Highway Patrol troopers arrived.

The patrol said it appeared that Porter was fatigued at the time of the rollover crash, and they don’t believe he was impaired. But troopers said they found a .45 caliber handgun and suspected marijuana in the car.

He was taken to the Mahoning County jail and was released on $4,000 bond about 10 a.m.

Porter also was charged with misdemeanor drug abuse after troopers found the suspected marijuana, but Judge Scott Hunter dismissed that charge Wednesday. Porter paid $71 in costs on that charge.

A docket entry in the case states the charge was dismissed because of “no valid statutory test at (the) state level.” The entry says prosecutors reserve the right to refile a charge “whenever applicable under the constitution, statutes or criminal rules of the state of Ohio.”

Attempts to get clarification on the drug-abuse charge late Wednesday from Ken Cardinal, assistant county prosecutor; or Hunter, were unsuccessful.

Hunter also dismissed the misdemeanor charge of not having a valid driver’s license, and Porter paid $20 in court costs on that charge.

Hunter also found Porter guilty of misdemeanor failure to control. Porter paid a $25 fine and paid court costs of $80 on that offense.

Cleveland selected Porter, who played with the University of Southern California, in the first round of the 2019 NBA Draft with the 30th overall pick. The Cavs’ preseason opens Dec. 12 against Indiana.
