Trial for JCC threat case delayed
CLEVELAND — James P. Reardon, 22, of New Middletown, who has been locked up awaiting trial on allegations of making a threat to the Jewish Community Center in Youngstown, has been granted another postponement of his trial date.
Reardon was scheduled for trial Dec. 15 and for a final pretrial this morning in U.S. District Court, but Reardon’s attorney, Ross T. Smith, asked for and received new hearing and trial date.
Reardon’s trial is now set for 9 a.m. March 9, and his final pretrial will be 11:30 a.m. Feb. 9.
Reardon has been in the Mahoning County jail since Aug. 17, 2019.
He is accused of transmitting an interstate communication threat and one count of possessing a firearm in furtherance of a crime of violence.
Authorities were alerted to a video post Reardon allegedly made on social media site Instagram. In the July 11, 2019, video, Reardon is seen holding a rifle in multiple firing positions — with audio of gunshots and sound effects of sirens and people screaming in the background.
The Instagram video is captioned: “the police have identified the shooter of the Youngstown Jewish Family Community Center as local white nationalist Seamus O’Rearedon” — Seamus being a Gaelic version of the name James.
Reardon’s attorney asked Judge Patricia Gaughan to postpone next month’s trial, saying he is “not comfortable with participating” in a trial because of the health and safety aspects of COVID-19 and will not consent to a trial “under the current circumstances.”
The filing adds, “Mr. Reardon also understands that additional time is required to continue the ongoing plea negotiations with the government and / or to prepare the matter for trial.”
Federal prosecutors do not oppose the postponement of the trial, Smith stated.
